Maintenance MS-47 Update

National Arbitrator Shyam Das ruled in the APWU’s favor on the national dispute involving management’s issuance and implementation of the 2001 MS-47.  Arbitrator Das ruled on November 16, 2006 that the USPS rescind the 2001 MS-47 and return to the 1983 MS-47 and staff in accordance with the 1983 MS-47. 

We are locally challenging management’ failure to comply with its requirement to staff in accordance with the 1983 MS-47 and also to implement the forms that the 1983 MS-47 requires – one of which is the implementation of route sheets.

The APWU at the national level is addressing the pay remedy, since Arbitrator Das remanded that issue to the parties at the national level to determine a remedy.  However, the APWU has had to go back to Arbitrator Das to issue a remedy on the pay issue.  The APWU had a hearing with Arbitrator Das on March 9, 2007 and presented its case with rights for rebuttal.  Management is scheduled to present its case most likely in June of 2007 – no date has yet been set. 

Both parties will then be afforded the opportunity to submit post hearing briefs, which could result in a decision being rendered sometime near the end of 2007.  Stay tuned, we will keep you posted as we learn more.

Once again, this is yet another example of USPS headquarters refusing to comply with an Arbitrator’s ruling and forcing the APWU to virtually turn them upside down and shake the money out of their pockets...Money that belonged to someone else all along!

PART TIME FLEXIBLE EMPLOYEES NOTE!

On Friday April 20 or Saturday April 21, 2007 the senior 16 Part Time Flexible (PTF) Clerk Craft employees at the Main PO, TCMH, and/or 554 Station and Branches will receive a preference sheet in the mail in a delivery confirmation envelope.  This sheet will contain a list of 16 full time “residual” job vacancies to preference on.  If you receive one of these letters you MUST preference these jobs or you may be assigned to one of the least desirable ones that are left over after all the other PTFs preference and Part Time Regulars (PTR) bid.  This sheet must be returned by Thursday April 26, 2007. 

The results should be posted in the May 3 award notice. The effective date of placement will be May 12, 2007.  Even though you are awarded a job, some of you may be put on a 1723 assignment order to work in a different location and schedule from the job that you are awarded.  If this happens then you will receive out of schedule pay (time and ˝) for all hours you work outside of the schedule of the job that you successfully preference on.

As contractually required these 16 jobs will be posted for PTRs to bid in the Vacancy Announcement due out April 19, 2007.  If any PTRs bid any of these jobs the number of PTFs converted will be reduced by the number of PTRs that bid.  So it is possible that some of the 16 PTF employees that receive preference sheets may not be converted.

PART TIME REGULAR EMPLOYEES NOTE!

On the Vacancy announcement due out on April 19, 2007 there will be 16 residual full time vacancies for the PTRs to bid on.  To make it easier to find these vacancies there will be a coversheet listing all them because these bids will be spread throughout the Vacancy Announcement.
